DAMPAK ADOPSI ILEGAL TERHADAP IDENTITAS DAN STATUS KEWARGANEGARAAN ANAK
Abstract
Illegal adoption remains a significant legal issue that threatens the protection of children's fundamental rights, particularly the right to identity and nationality. Although Indonesia has established comprehensive regulations governing child adoption, unlawful adoption practices, especially in intercountry adoption, continue to occur. Such practices not only violate legal procedures but also create long-term legal consequences affecting children's identity, family relationships, and citizenship status. This study examines the case of Indra Jaya Laksana, an alleged victim of illegal adoption, who experienced difficulties in reclaiming his identity and obtaining recognition as an Indonesian citizen. The study aims to analyze the legal consequences of illegal adoption on identity and nationality, identify the factors contributing to illegal intercountry adoption, and examine the legal remedies available for victims seeking the restoration of their Indonesian citizenship. This research employs a normative legal research method using a qualitative approach. Data were collected through library research consisting of primary, secondary, and tertiary legal materials. The data were analyzed descriptively by examining relevant laws and regulations and relating them to the legal facts of the Indra Jaya Laksana case. The findings indicate that illegal adoption results in the loss of legal identity, the severance of biological family relationships, and uncertainty regarding the victim's nationality status. The main contributing factors include non-compliance with legal adoption procedures, inadequate protection of children's identity, weak supervision of intercountry adoption, and ineffective law enforcement. The study concludes that restoring victims' rights requires identity verification, recognition of biological family relationships, and legal mechanisms to regain Indonesian citizenship. Therefore, the Indonesian government should strengthen supervision of child adoption, improve inter-agency coordination, and establish a special legal mechanism to ensure the protection of identity and nationality rights for victims of illegal adoption.
